Introduction
Gathro Platform seeks to provide a suitable environment in which consumers obtain services from providers easily and conveniently. Accordingly, the platform has prepared these Terms and Conditions, which set out the rights and obligations of consumers and constitute a legally binding contract for all parties.
Definitions:
- •Gathro Platform: an electronic platform owned by the Bahraini company Codemedia, unified commercial registration number (184787-1), operating online and providing intermediary services for entertainment and tourism services.
- •Service Provider: a natural or legal person who offers entertainment or tourism services through the platform.
- •Consumer: a natural or legal person who purchases a service from a service provider through the platform.
- •User: any natural or legal person—service provider, consumer, or otherwise—who uses the platform.
- •Account: an electronic page on the platform through which a service provider displays services and products to consumers.
- •Account Login Information: username, password, email, and password-recovery question and answer.
- •Cookies: small text files created by the browser and stored on the user’s device when visiting a website, used to save certain interaction information so it can be retrieved on later visits.
- •Terms: the terms and conditions governing consumer use of Gathro Platform.
Binding Effect:
Use of the platform constitutes acceptance of these Terms and of the rights and obligations of the platform and the user set out herein. The user may not later reject these Terms or claim lack of knowledge.
Scope and Application:
- •These Terms apply only to users’ dealings with the platform and do not extend to service providers (natural or legal persons) who offer services through the platform. The platform is an intermediary connecting providers and consumers.
- •Without prejudice to the above, and pursuant to applicable laws, the platform provides a complaints mechanism between consumers and providers. Its role is limited to technical verification of the complaint and attempting to bring viewpoints closer, without becoming a party to the complaint and without being obliged to achieve a particular outcome.
Limitation of Liability:
- •The platform’s liability is limited to the services it provides, namely making accounts available to users (consumers and providers) to complete dealings between them and related services such as electronic payment gateways.
- •Without prejudice to legal responsibilities, the platform has no involvement in how a provider delivers or prices services—whether above or below market rates—as that is solely within the provider’s discretion.
- •Without prejudice to legal responsibilities, the platform has no relationship with services offered by providers so long as they remain within lawful bounds and do not misrepresent the service.
- •The consumer browses and acts at their own responsibility and alone bears the consequences of resulting dealings. The platform is not liable for the consumer’s failure to verify a service description or for haste in submitting a service request.
- •Without prejudice to legal responsibilities and these Terms, services offered by the platform to improve user experience do not constitute an obligation to achieve a particular result for any party.
- •The user acknowledges that the platform bears no financial costs, compensation, or liability arising from financial loss, reputational harm, defamation, or other damage resulting from misuse of the platform by users, nor for negligence or other harm caused by a third party. The injured party may pursue the responsible party before the competent governmental and judicial authorities.
- •The relationship between consumer and provider is governed by commercial and civil laws. The platform is not a party to dealings between them except as required by law or these Terms.
- •All dealings between providers and consumers are independent legal relationships. In case of a dispute, competence lies with the relevant authorities such as the Ministry of Commerce and the courts.
Legal Obligations:
- •The user—whether a natural or legal person—represents that they have legal capacity to deal through the platform and must stop using the account if capacity ceases or is impaired. The platform bears no legal liability if use continues after capacity is lost or impaired.
- •The user must comply with Islamic Sharia and applicable laws that do not conflict with it in dealings with other users, and alone bears consequences, claims, and compensation arising from their conduct.
- •The user acknowledges that use of the platform is subject to e-commerce, personal data protection, electronic transactions, and related commercial or civil laws.
Terms of Use:
- •Any person who meets the legal requirements may create an account on the platform, provided they supply all platform and regulatory requirements and keep that information updated to receive services correctly.
- •Users must deal with others while using the platform with good manners, honor, and honesty; observe religious and social values; and pursue lawful earning and dealings.
- •Without prejudice to the above, and to protect the platform’s reputation, the platform may suspend a user’s account and block access if the user commits violations against the platform, its users, or third parties. The platform may, at its discretion or pursuant to law, reactivate the account.
- •The user acknowledges the platform’s tangible and intangible rights in all content on the platform. No one may use that content in any form—directly, indirectly, or through a third party—including without limitation written and non-written text, graphic designs, technical ideas, logos, offers, icons, symbols, audio clips, aggregated data, and software.
Financial Dealings:
- •Without prejudice to these Terms, the platform provides electronic payment gateways through its partners. The platform is not a party to gateway transactions; the relationship is between account holders, banks, and the gateway partner.
- •The platform may review financial transactions through payment gateways or cash-on-delivery services in connection with its right to commissions on orders.
Rights:
- •Subject to the Privacy Policy and applicable personal data protection laws, the user may cancel their account at any time through the technical services available on the platform.
- •A user whose account was suspended by the platform may apply to the courts for reactivation; the platform is bound by the final judgment.
- •Any user may report to the platform or governmental authorities any unlawful product or service displayed on a provider’s account, and the platform may take necessary action against the provider.
- •The consumer may apply to the competent governmental or judicial authorities to resolve disputes arising between the consumer and the provider.
Complaints and Consumer Compensation:
- •The consumer may submit a complaint to the provider regarding the ordered service within 48 hours of receiving the service. If the provider does not respond or no amicable settlement is reached, the consumer may escalate the complaint to the platform within 24 hours of that failure, exclusively in the following cases:
- •The provider cancelled the service request.
- •The consumer was not enabled to receive the ordered service.
- •The provider failed to meet the regulatory requirements for providing the service.
- •The service did not match the description on the service page.
- •The platform verifies the complaint using available technical means and documents provided by the consumer, and asks the provider to respond. If the platform finds the provider in breach of paragraph (1) above, it may deduct all or part of the provider’s dues to compensate the consumer.
- •For cash-on-delivery orders, all complaint procedures apply except consumer compensation through the platform; the consumer may complain to the competent governmental and judicial authorities.
- •If the platform decides that no provider breach under paragraph (1) is established, it directs the consumer to the competent governmental and judicial authorities.
- •The platform is relieved of the above if the consumer fails to file the complaint within the stated time limits.
Amendments:
The platform may amend these Terms in a manner that increases or decreases user rights or obligations for its legitimate purposes or to comply with law, and will notify users by email or through announcements on the platform.
For notification purposes, the user agrees to receive notices related to these Terms via in-app pop-up notifications when accessing the account, when refreshing the account page in a browser, or via the email registered on the account. Such notices shall in all cases produce their legal effects.
Governing Law:
These Terms were prepared in accordance with applicable laws and regulations. If a dispute arises to which the platform is a party, jurisdiction shall lie with the competent courts.
